Antitrust Counseling to Global Firms and Others<\/h2>\n
Mr. Markham provides counseling on antitrust matters<\/a>, patent misuse<\/a>, patent licensing, non-compete covenants, non-solicitation covenants, and all other kinds of contractual trade restraints (covenants that limit or proscribe future commercial activity).<\/p>\n
Among other engagements, he has served as the United States antitrust adviser to the world\u2019s largest manufacturer of LED products in various strategic matters for the company. He has also provided antitrust counseling to a global automobile manufacturer concerning its multinational acquisitions and divestitures.<\/p>\n
He previously provided strategic antitrust counseling and guidance to the world\u2019s leading manufacturer of pulse oximetry equipment in various matters and advised its patent attorneys about antitrust matters during a series of bet-the-company patent and antitrust litigations. One of these cases was against a major Chinese manufacturer and settled on the eve of trial. The other controversy was litigated in a series of cases against a global European conglomerate; all of these cases were resolved by a global settlement agreement.<\/p>\n
More generally, Mr. Markham has advised many companies over the years in significant antitrust matters\u00a0of various kinds that have arisen in various industries<\/a>. His clients have included global firms, major competitors, fledgling competitors, suppliers, firms poised to excel in their markets, disruptive innovators, and business customers.<\/p>\n

Trademark Litigation, False Advertising Claims, and Other Complex Business Litigation<\/h2>\n
Mr. Markham has served as the lead attorney for large clients in litigations for trademark infringement, product-counterfeiting, and false advertising arising under the federal Lanham Act and California\u2019s statutory and common law on unfair competition.<\/p>\n
In one such case, he was the lead attorney for an alleged ringleader defendant in the sprawling \u201c5-Hour energy\u201d counterfeiting litigations (Innovation Ventures LLC v. Pittsburgh Wholesale Grocers, Inc.,\u00a0<\/em>N.D. Cal., 2012; Case No. 12-CV-5523-WHA).<\/p>\n
He also served several times as the lead attorney in cases for commercial fraud and securities fraud and is proficient in the federal and state laws that govern these kinds of disputes: in fraud cases, the outcome typically depends on uncovering and clearly explaining complicated, initially confusing facts.<\/p>\n
In a recent matter, Mr. Markham served as the lead appellate attorney in a long-running litigation over a property development in which the jury rendered verdicts for his client on all claims, but the trial court relieved one defendant from these verdicts. Mr. Markham obtained a reversal of this outcome on appeal, a reinstatement of the jury’s overturned verdicts on all disputed points, a dismissal of an opposing appeal, and a remand to the trial court for a trial to set the amount of punitive damages that each defendant must pay. The original jury trial in this case was conducted by a gifted trial attorney, the late Daral Mazzarella. Mr. Markham became the lead attorney shortly after Mr. Mazzarella pased away. Trial Work and Appeals<\/h2>\n
Early in his career, Mr. Markham tried many smaller civil matters and thereby gained significant trial experience, and since then he has tried several larger matters, winning both jury verdicts and bench verdicts after fully contested trials in difficult, intractable controversies.<\/p>\n
Mr. Markham’s most recent trial was a three-day bench trial in United States Bankruptcy Court (S.D. Cal., 2014), in which his client prevailed and established that the full amount of her state-court judgment against the debtor was nondischargeable in bankruptcy. Mr. Markham has also litigated various appeals<\/a> in federal and California courts, obtaining affirmances of successful outcomes as well as three appellate reversals of judgments rendered against his clients \u2014 one from the federal Ninth Circuit Court of Appeals and two from the California Court of Appeal for the Fourth Appellate District of California.<\/p>\n
Specifically, Mr. Markham obtained appellate reversals<\/a> in 2012, 2019, and 2024 of judgments rendered below by trial courts (two state-court judgments and one federal judgment in an antitrust case). His most recent appellate victory arose in a long-running, complex litigation that concerns a substantial property development in Orange County. Case Name<\/strong>: Wardak v. Summary Judgment Against a Global Bank in Complex Lender Litigation<\/h2>\n
In one recent case (concluded in 2018), Mr. Markham prevailed on the merits before<\/em> trial, defeating a lender\u2019s claim to perfect and enforce an equitable lien on summary judgment. In that case, the world\u2019s largest bank, JPMorgan Chase Bank, N.A., sought to perfect and enforce its lien rights by seizing and selling a highly valuable property in San Diego in order to satisfy an old debt.<\/p>\n
After a particularly arduous litigation, Mr. Markham\u2019s clients prevailed on summary judgment by showing that the lender\u2019s confusingly stated claims, once properly characterized, were time-barred as a matter of law.<\/p>\n
Mr. Markham subsequently recovered his attorney\u2019s fees and costs of suit from the lender, with an upward multiplier to reflect his contingent fee and the excellence of his work. Professional Qualifications and Experience<\/h2>\n
Mr. Markham received his law degree in 1987 from Harvard Law School after graduating with highest honors from the University of California, Santa Barbara in 1984. While at law school, he served as an editor and later as an associate editor of the Harvard International Law Journal<\/a>. After his second year of law school, he served as a summer clerk in Montr\u00e9al, Qu\u00e9bec in the competition group of one of Canada\u2019s leading law firms, Ogilvy Renault<\/a>\u00a0(now part of Norton Rose Fulbright).<\/p>\n
After law school, Mr. Markham passed the California Bar exam on his first attempt and was admitted by petition to the District of Columbia Bar Association. He received his initial training as an antitrust litigator in a leading global law firm\u00a0(Coudert Bros<\/a>, now dissolved), whose clients included sovereign governments, Fortune 500 and Fortune 100 companies, universities, and other prominent companies and individuals.<\/p>\n
In 1990, he opened his own practice with the aim of trying his own cases in court while still a young attorney. He thereafter tried many smaller matters and over time evolved into a skillful, accomplished trial attorney who sometimes tries substantial business and real property disputes that cannot be settled.<\/p>\n
Since 2005, he has mostly litigated a particular subset of antitrust litigation called “competitor claims,” which are antitrust claims that one business or group of businesses bring against one or more competitors. He has been lead attorney in several such cases and has also provided antitrust counseling to many businesses, including several well-established global firms.<\/p>\n
He also litigates complex commercial claims for breach of contract and various business torts, and he occasionally litigates claims for false advertising and trademark infringement.<\/p>\n
Trying cases in court has been his essential work and the organizing principle of all of his litigations, even those that settle.<\/p>\n
In recent years, he has also gained substantial experience conducting appeals<\/a> of antitrust claims and other kinds of business claims.<\/p>\n

Utah, 2016. Case No. 2:16-cv-01183). Mr. Markham was the first attorney to develop this antitrust challenge in a case that was later consolidated with several similar cases.<\/li>\r\n \t
- The lead appellate attorney for a regional shipper in appellate antitrust litigation against the owner of the sole commercial port that serves Santa Catalina Island as well as its favored shipper (Curtin Maritime Corp. v. In that matter, Mr. Markham obtained from the Ninth Circuit Court of Appeals an appellate reversal of the judgment given below, by which the case had been dismissed with prejudice by the United States District Court for the Central District of California. - The lead attorney for a distributor of medical devices in significant antitrust litigation under California law against two manufacturers and their favored distributor (SMRT LLC v. Case No. 37-2011-00087297). <\/em><\/em><\/em><\/em><\/em><\/em>The case survived the Defendants' aggressive litigation of the pleadings, then settled on confidential terms shortly after discovery procedures began.<\/li>\r\n<\/ul>\r\n<\/li>\r\n<\/ul>\r\n

- The lead attorney for the largest private manufacturer of precast concrete products in North America, bringing an antitrust challenge against the world's largest manufacturer of these kinds of products and its trading partner, a global telecommunications firm (Jensen Enterprises, Inc. v. Oldcastle Precast, Inc., <\/em>N.D. Cal., 2006. Case No. C 06 0247). The case was litigated for approximately four years in federal district court and then in the Ninth Circuit, surviving the defendants' challenge to the pleadings and their first round of motions for summary judgment. All discovery procedures in the case and most pre-trial preparations were completed before the district court dismissed the case shortly before trial in response to the defendants' second round of motions for summary judgment. That dismissal was affirmed on appeal after full appellate proceedings. Shortly after Mr. Markham filed the case, the defendants afforded substantial prospective<\/em> relief, ending the parties' principal dispute at the outset of the case.<\/li>\r\n<\/ul>\r\n<\/li>\r\n<\/ul>\r\n<\/a>\r\n
Antitrust Counseling to Global Firms and Others<\/h3>\r\nMr. Markham also provides counseling on antitrust matters<\/a>, patent misuse<\/a>, patent licensing, non-compete covenants, non-solicitation covenants, and all other kinds of contractual trade restraints (covenants that limit or proscribe future commercial activity). Among other engagements, Mr. Markham has served as the United States antitrust adviser to the world\u2019s largest manufacturer of LED products in various strategic matters for the company and has provided antitrust counseling to a global automobile manufacturer concerning its multinational acquisitions and divestitures. He has also provided strategic antitrust counseling and guidance to the world's leading manufacturer of pulse oximetry equipment in various matters and advised its patent attorneys about antitrust matters during its recent, bet-the-company patent and antitrust litigation. More generally, Mr. Markham has advised many companies over the years in significant antitrust matters<\/a>\u00a0of various kinds that have arisen in various industries<\/a>. His clients have included global firms, major competitors, fledgling competitors, suppliers, and business customers.\r\n<\/a>\r\n
Trademark Litigation, False Advertising Claims, and Other Complex Business Litigation<\/h3>\r\nMr. Markham has served as the lead attorney for large clients in litigations for trademark infringement, product-counterfeiting, and false advertising arising under the federal Lanham Act and California's statutory and common law on unfair competition. In one such case, he was the lead attorney for an alleged ringleader defendant in the sprawling \"5-Hour energy\" counterfeiting litigations (Innovation Ventures LLC v. Pittsburgh Wholesale Grocers, Inc.,\u00a0<\/em>N.D. Cal., 2012). He has also served several times as the lead attorney in cases for commercial fraud and securities fraud and is proficient in the federal and state laws that govern these kinds of disputes: in fraud cases, the outcome typically depends on uncovering and clearly explaining complicated, initially confusing facts.\r\n<\/a>\r\n
Trial Work and Appeals<\/h3>\r\nEarly in his career, Mr. Markham tried many smaller civil matters and thereby gained significant trial experience, and since then he has tried several larger matters, winning both jury verdicts and bench verdicts after fully contested trials in difficult, intractable controversies. His most recent trial was a three-day bench trial in United States Bankruptcy Court (S.D. Cal., 2014), in which his client prevailed and established that the full amount of her state-court judgment against the debtor was nondischargeable in bankruptcy. (After obtaining this judgment, the parties reached a final settlement of all outstanding disputes between them.) He relishes trying cases and will readily proceed to trial<\/a> if he cannot obtain a satisfactory settlement for his client. This circumstance in turn seems to help him to elicit favorable settlements from adversaries who grasp that he can try the case if it cannot be settled on reasonable terms. In fact, he has\u00a0obtained many successful settlements<\/a> for both plaintiffs and defendants and in particular has obtained large recoveries for several of his clients in closely contested, fully litigated matters, which he would have tried if no settlement had been reached.\r\n<\/a>\r\n
Summary Judgment Against a Global Bank in Complex Lender Litigation<\/strong><\/h3>\r\nIn one very recent case (concluded in 2018), Mr. Markham prevailed on the merits before<\/em> trial, defeating a lender's claim to perfect and enforce an equitable lien on summary judgment. In that case, the world's largest bank, JPMorgan Chase Bank, N.A., sought to perfect and enforce its lien rights by seizing and selling a highly valuable property in San Diego in order to satisfy an old debt. After a particularly arduous litigation, Mr. Markham's clients prevailed on summary judgment by showing that the lender's confusingly stated claims, once properly characterized, were barred as a matter of law. Mr. Markham subsequently recovered his attorney's fees and costs of suit from the lender, with an upward multiplier to reflect his contingent fee and the excellence of his work. The lender thereafter abandoned its appeal, ending this matter definitively. Case Name: JPMorgan Chase Bank, N.A. v. Cho et al<\/em>. (Cal. Sup. Ct., SD Cty., 37-2016-00045054-CU-OR-CTL).\r\n<\/a>\r\n
Professional Qualifications and Experience<\/h3>\r\nMr. Markham received his law degree in 1987 from Harvard Law School after graduating with highest honors from the University of California, Santa Barbara in 1984. While at law school, Mr. Markham served as an editor and later as an associate editor of the\u00a0Harvard International Law Journal<\/a>, and he worked as a summer clerk in Montr\u00e9al, Qu\u00e9bec in the competition group of one of Canada's leading law firms, Ogilvy Renault<\/a>\u00a0(now part of Norton Rose Fulbright).\r\n\r\nAfter law school, Mr. Markham passed the California Bar exam on his first attempt and was admitted by petition to the District of Columbia Bar Association because of his qualifying high score on the California Bar exam. He received his initial training as an antitrust litigator in a leading global law firm\u00a0(Coudert Bros<\/a>, now dissolved), whose clients included sovereign governments, other government agencies, Fortune 500 and Fortune 100 companies, universities, and other prominent companies and individuals. - The lead attorney for the largest private manufacturer of precast concrete products in North America, bringing an antitrust challenge against the world's largest manufacturer of these kinds of products and its trading partner, a global telecommunications firm (Jensen Enterprises, Inc. v. Oldcastle Precast, Inc., <\/em>N.D. Cal., 2006. Case No. C 06 0247). The case was litigated for approximately four years in federal district court and then in the Ninth Circuit, surviving the defendants' challenge to the pleadings and their first round of motions for summary judgment. All discovery procedures in the case and most pre-trial preparations were completed before the district court dismissed the case shortly before trial in response to the defendants' second round of motions for summary judgment. That dismissal was affirmed on appeal after full appellate proceedings. Shortly after Mr. Markham filed the case, the defendants afforded substantial prospective<\/em> relief, ending the parties' principal dispute at the outset of the case.<\/li>\r\n<\/ul>\r\n<\/li>\r\n<\/ul>\r\n<\/a>\r\n

- The lead attorney for a distributor of medical devices in significant antitrust litigation under California law against two manufacturers and their favored distributor (SMRT LLC v. Resmed Corp.,\u00a0<\/em>Cal. Sup. Ct., S.D. Cty., 2011. Case No. 37-2011-00087297). <\/em><\/em><\/em><\/em><\/em><\/em>The case survived the Defendants' aggressive litigation of the pleadings, then settled on confidential terms shortly after discovery procedures began.<\/li>\r\n<\/ul>\r\n<\/li>\r\n<\/ul>\r\n

- The lead attorney for a publicly-traded retailer of hardware supplies, asserting claims for antitrust violations and false advertising against the dominant national retailer and two of its suppliers. These claims survived the defendants' protracted challenge to their legal sufficiency and led to a published decision. The case settled soon thereafter in accordance with a confidential settlement agreement. (Orchard Supply Hardware LLC v. Home Depot USA, Inc., <\/em>N.D. Cal., 2012. - The lead appellate attorney for a regional shipper in appellate antitrust litigation against the owner of the sole commercial port that serves Santa Catalina Island as well as its favored shipper (Curtin Maritime Corp. v. Santa Catalina Island Co.<\/em>, 9th Cir., 2018, Appeal No. 18-55338). In that matter, Mr. Markham obtained from the Ninth Circuit Court of Appeals an appellate reversal of the judgment given below, by which the case had been dismissed with prejudice by the United States District Court for the Central District of California. The case is again pending in the Central District of California.<\/li>\r\n<\/ul>\r\n<\/li>\r\n<\/ul>\r\n
- Currently, co-counsel with several leading law firms in a private antitrust challenge against restraints on competitive advertising practiced by the world's largest retailer of contact lenses and several of its smaller competitors (Thompson v. 1-800 Contacts, Inc. <\/em>(D. Utah, 2016. Case No. 2:16-cv-01183). Mr. Markham was the first attorney to develop this antitrust challenge in a case that was later consolidated with several similar cases.<\/li>\r\n \t
