Published Decision, Followed By Successful Antitrust Settlement

Published Decision and Confidential Settlement Against Largest Hardware Retailer in U.S.

On behalf of a publicly-traded hardware retailer, we obtained a published decision that upheld our pleading of claims for restraint of trade against the largest retailer of hardware products in the United States. See Orchard Supply Hardware LLC v. Home Depot USA, Inc., 967 F. Supp. 2d 1347 (N.D. Cal. 2013). We thereafter settled the case under a confidential settlement agreement. In this case, we alleged that the dominant retailer used trade restraints with major suppliers of specialized tools to undermine our client’s innovative retail operations in the hardware sector.
